These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, or “Referrer”) and Pixmart Digital Solutions Pvt. Ltd. (“Pixmart”, “we”, “us”, or “our”), governing your access to and use of the website https://pixmart.in, customer dashboards, digital courses, software assets, and associated services.
By registering an account, making a purchase, or participating in the referral program, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our related policies, including the Privacy Policy and Refund Policy.
2. Eligibility & Account Security
To access Pixmart and purchase digital products or earn referral rewards, you must:
- Be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872.
- Provide accurate, genuine, and verifiable information (including legal name, phone number, and email address).
- Maintain the confidentiality of your login credentials. You are solely responsible for all activities occurring under your account.
- Create no more than one account per individual. Duplicate accounts sharing mobile numbers, email, or PAN will trigger automated fraud review and account suspension.
3. Digital Products & Intellectual Property License
All courses, video lessons, downloadable files, templates, and ebooks sold on Pixmart are the proprietary intellectual property of Pixmart or our verified licensors.
Upon successful payment, you are granted a limited, non-exclusive, non-transferable, revocable license to access, stream, and download the purchased materials strictly for your personal learning or business development. You expressly agree that you will NOT:
- Resell, sublicense, distribute, duplicate, or publicly broadcast any course materials or source assets.
- Share login credentials, download links, or streaming tokens with non-paying third parties.
- Use web-scraping, automated bots, or downloading tools to extract raw media without authorization.
4. Pricing, 18% GST & Payments
All prices displayed on Pixmart are in Indian Rupees (INR) and are inclusive of statutory 18% Goods & Services Tax (GST). All payments are securely processed through RBI-authorized payment aggregators (Razorpay). Upon payment completion, an official GST tax invoice is generated and permanently accessible in your customer dashboard under “Invoices”.
5. Referral & Affiliate Reward Program
Pixmart offers a performance-based affiliate incentive program strictly governed by the following rules:
- Purchase Prerequisite (canRefer Gate): Referral privileges and shareable referral links unlock only after your first genuine paid product purchase. Free registered users cannot refer others.
- Sales Commission Only: Commissions are paid strictly upon genuine, verified product sales across 3 tiers (Level 1: 38%, Level 2: 8%, Level 3: 3% of net product value excluding 18% GST). We pay zero recruitment or joining fees.
- Cooling-off Hold: All commission earnings are subject to a mandatory 24-hour holding period to account for consumer refund eligibility. Approved commissions transfer to your available wallet balance upon maturity.
- Mandatory KYC & 5% TDS: Wallet withdrawals require approved KYC (PAN, address, and matching bank details) and are subject to 5% Tax Deducted at Source (TDS) under Section 194H of the Income Tax Act.
6. Code of Conduct & Anti-Fraud Enforcement
Users are strictly prohibited from engaging in deceptive, unethical, or illegal practices, including:
- Making exaggerated, misleading, or guaranteed income claims when sharing referral links.
- Self-referring across fake accounts to harvest upline commissions.
- Spamming unsolicited messages, emails, or deceptive social media ads.
- Attempting to bypass access controls, spoof tokens, or interfere with system security.
Violations will result in immediate account termination, forfeiture of pending commissions, and potential legal action.
7. Limitation of Liability & Disclaimers
To the maximum extent permitted by applicable Indian law, Pixmart provides all products, services, and content “as is” without warranties of any kind. We do not guarantee that your use of our courses or marketing of our products will yield specific financial earnings or business outcomes.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. In the event of any dispute, controversy, or claim arising out of these Terms, the parties shall first attempt to resolve it through good-faith mutual consultation. If unresolved, the competent courts at New Delhi, India shall have exclusive jurisdiction.
